Privacy Policy

I. Personal Information Protection Policy

Tokyu Land US Corporation. (hereinafter, the “Company”) complies with the applicable laws and regulations regarding the protection of personal information of customers, business partners, and Company employees obtained over the course of operations, and complied with rules and a framework for handling such information.

II. Categories and Sources of Personal Information we may Collect

We may collect the following categories of personal information when you use our website or services:

  • Identifiers, such as first and last name, postal/physical address, email address, telephone number
  • Personal information categories listed in the California Customer Records Statute (Cal. Civ. Code § 1798.80(e)), such as first and last name, address or telephone number. Please note some personal information included in this category may overlap with other categories.
  • Internet or Other Electronic Network Activity Information, such as browsing history, search history, and information regarding a consumer’s interaction with an internet website application, or advertisement.
  • Geolocation Data

We collect this personal information directly from you and from third-party sources, such as affiliates, business partners, public databases, joint marketing partners, and social media platforms.

III. Purpose of Use of Personal Information

The Company shall not use obtained personal information for any purpose beyond the below business and commercial purposes without obtaining consent from the relevant customer. The personal information that the Company has obtained shall be used for the following business and commercial purposes only:

  • Responding to inquiries, requests, and applications from customers;
  • Contacting applicants of the Company’s recruiting activities and using for any other general recruiting work;
  • For any other purposes identified when obtaining the relevant personal information; and
  • When required to comply with any provisions in any applicable laws and regulations, or follow any government notifications, guidelines, etc.

IV. Retention of Personal Information

We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was collected. The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide services to you (for example, for as long as you keep using our services) and the length of time thereafter during which we may have a legitimate need to reference your personal information to address issues that may arise;
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or
  • Whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

V. Sharing of Personal Information

We may share the types of personal information described above with the following categories of third parties for a commercial or business purpose:

  • Service Providers: Third-party vendors that help us operate our website or provide services on our behalf, such as hosting providers, analytics providers, customer support tools, and email delivery services.
  • Professional Advisors: Attorneys, auditors, accountants, or other professional advisors who provide services to us.
  • Compliance and Legal Recipients: Government authorities, law enforcement, or other parties when required to comply with applicable law, legal process, or to protect our rights.
  • Other Parties With Your Consent: Any third party to whom you authorize us to disclose your information.

In addition, Company may disclose personal information and other information we obtain from you to a third party in the event and/or consideration of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock.

In the preceding twelve (12) months, the Company has not sold personal information.

In the preceding twelve (12) months, the Company has not sold or otherwise shared personal information for cross-context behavioral advertising purposes. Without limiting the foregoing, we do not sell or share (for cross-context behavioral advertising purposes) the personal information of minors under 16 years of age.

VI. Tracking Technologies

Third parties, including analytics and security providers, may collect information about your online activities over time and across different websites when you use our website. These third parties’ data practices are governed by their own privacy policies as further set forth below.

Cookies and Web Beacons

We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Site to help customize the Site and improve your experience. When you access the Site, your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies but be aware that such action could affect the availability and functionality of the Site. You may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.

Website Analytics

We may also partner with selected third-party vendors, such as Google Analytics and others, to allow tracking technologies and remarketing services on the Site through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of the Site, determine the popularity of certain content and better understand online activity. By accessing the Site, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer personal information to these third-party vendors. However, if you do not want any information to be collected and used by tracking technologies, you can visit the third-party vendor or the Network Advertising Initiative Opt-Out Tool or Digital Advertising Alliance Opt-Out Tool. You should be aware that getting a new computer, installing a new browser, upgrading an existing browser, or erasing or otherwise altering your browser’s cookies files may also clear certain opt-out cookies, plug-ins, or settings.

Do Not Track Signals

Some web browsers offer a “Do Not Track” (DNT) setting that sends a signal to websites requesting that the visitor’s browsing activity not be tracked. Because there is no widely accepted industry standard for how to interpret or act upon DNT signals, our website is not currently configured to respond to or recognize these signals. As a result, if you enable DNT in your browser, our website (and our service providers) may still collect and process information as described in this Privacy Policy.

VII. Your Rights Under the CCPA/CPRA, TDPSA, and NDPA and How to Exercise Them.

Residents of California have certain rights under the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), residents of Texas have certain rights under the Texas Data Privacy and Security Act (“TDPSA”), and residents of Nebraska have certain rights under the Nebraska Data Privacy Act (“NDPA”, and collectively with the CCPA, CPRA and TDPSA, the “State Privacy Laws”) which may be exercised by their respective state residents. This section describes your State Privacy Law rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that the Company disclose certain information to you about our collection and use of your personal information. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, Deletion and Correction), we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request). Please note that this request is limited to information you provided to the Company for Texas and Nebraska residents.

Deletion Request Rights

You have the right to request that the Company delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, Deletion and Correction), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Correct

You have the right to request the Company to correct inaccurate personal information collected about you. We will make commercially reasonable efforts to correct any inaccurate personal information we hold about a consumer within 45 days of receiving a verifiable consumer request. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

Right to Opt-Out of Personal Information Sales and Sharing

If you are age 16 or older, you have the right to direct us to not sell or share your personal information for cross-context behavioral advertising purposes at any time (the “right to opt-out”). You may submit a request to “opt-out” by using the link provided below. Please note that some uses of personal information may not be considered “sales” or “sharing” under the applicable State Privacy Law and certain exemptions may apply under the applicable State Privacy Law.

You have the right to direct us to not sell or share your personal information for cross-context behavioral advertising purposes at any time (the “right to opt-out”). Please note that we do not currently engage in sales or sharing of personal information triggering such opt-out requirements.

Once you make an opt-out request, it will remain valid for twelve (12) months from the date of the request.

We will only use personal information provided in an opt-out request to review and comply with the request.

Right to Limit Disclosure or Use of Sensitive Personal Information

You have the right to limit the disclosure or use of your sensitive personal information to only those actions necessary for the Company to provide goods and services to you or as otherwise specifically directed by you. Please note that we do not currently collect or use sensitive personal information to infer characteristics about consumers triggering such limitation rights.

Exercising Access, Data Portability, Deletion and Correction Rights

To exercise the access, data portability, deletion and correction rights described above, please submit a verifiable consumer request to us by either:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent, you must first verify your identity directly with us and provide written authorization to your agent to make requests on your behalf.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:
    • Your name, address, and any other information we may require to verify your identity.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

We will deliver our written response by mail or electronically, at your option.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically .csv format.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your State Privacy Law rights. Unless permitted by the applicable State Privacy Law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Appeal Process

If you are a Nebraska, or Texas consumer, and we refuse to take action on your request, you may appeal our refusal within a reasonable period after you have received notice of the refusal. You may file an appeal by contacting us via 424-372-3400 or https://www.tlusc.com/.

VIII. Security of Your Information

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

IX. Changes to our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the website home page. If we make material changes to how we treat your Personal Information, we will notify you through a notice on the Website. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our website and this privacy policy to check for any changes.
